SearchCabs Terms & Conditions

SearchCabs is an undertaking of East India Traders (GSTIN: 08EISPM9747Q1ZR).

These Terms & Conditions (“Terms”) govern your access to and use of the SearchCabs website, mobile application, and related services (“Platform”). SearchCabs is owned and operated by East India Traders, a proprietorship registered in India.

Throughout these Terms, the words “SearchCabs”, “we”, “our”, and “us” refer to East India Traders, the legal owner and operator of the SearchCabs platform.

1. About SearchCabs

By registering, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree with these Terms, you must not use the Platform.

SearchCabs is a Business-to-Business (B2B) technology platform that enables taxi operators, travel agencies, fleet owners, and transport vendors to connect with each other for transportation-related business opportunities.

SearchCabs is not a transport company, travel agency, tour operator, taxi operator, or employer of any driver or vendor.

The Platform merely facilitates communication between registered businesses.

2. Eligibility

You must:

  • Be at least 18 years of age.
  • Operate a legitimate transportation-related business.
  • Provide accurate registration details.
  • Comply with all applicable Indian laws.

SearchCabs may reject or suspend any registration without prior notice.

3. Business Relationship

All transportation services are provided directly by the participating taxi operator or vendor.

SearchCabs:

  • does not provide transportation services;
  • is not a party to any booking contract;
  • does not guarantee any booking;
  • does not guarantee payments;
  • does not guarantee customer availability.

The contract for every trip exists solely between the participating businesses.

4. User Accounts

Users are responsible for:

  • maintaining account security;
  • keeping login credentials confidential;
  • ensuring all submitted information remains accurate;
  • all activities conducted through their account.

SearchCabs may suspend accounts involved in fraud, abuse, or misuse.

5. Booking Requests

The Platform allows users to:

  • post transportation requirements;
  • receive quotations or bids;
  • negotiate rates;
  • exchange contact details;
  • coordinate transportation.

SearchCabs is not responsible for whether a booking is accepted, completed, cancelled, or modified.

6. Pricing

Users independently determine:

  • fares;
  • commissions;
  • payment terms;
  • cancellation policies;
  • taxes.

SearchCabs has no control over pricing decisions.

7. Payments

Currently, SearchCabs does not collect payments on behalf of users.

Payments are settled directly between participating businesses.

SearchCabs is not responsible for:

  • unpaid invoices;
  • delayed payments;
  • fraudulent payments;
  • payment disputes.

8. Taxes

Each user is solely responsible for:

  • GST compliance;
  • invoicing;
  • TDS obligations;
  • income tax;
  • permits;
  • statutory registrations.

SearchCabs is not responsible for any user’s tax obligations.

9. Operator Responsibilities

Operators agree to:

  • maintain valid permits;
  • possess valid commercial vehicle registrations;
  • maintain insurance;
  • employ licensed drivers;
  • comply with transport regulations;
  • provide accurate vehicle information;
  • maintain vehicles in roadworthy condition.

10. Prohibited Activities

Users shall not:

  • post false bookings;
  • manipulate bidding;
  • impersonate another business;
  • use fake identities;
  • submit misleading documents;
  • harass other users;
  • upload unlawful content;
  • interfere with Platform operations;
  • attempt unauthorized access;
  • misuse another user’s contact information;
  • engage in illegal activities.

11. Ratings and Reviews

Users may rate other businesses based on genuine business experiences.

SearchCabs reserves the right to remove:

  • fake reviews;
  • abusive reviews;
  • defamatory content;
  • spam.

12. User Content

Users retain ownership of the information they upload.

By uploading content, users grant SearchCabs a non-exclusive license to display, store, and process such information for operating the Platform.

13. Intellectual Property

All trademarks, software, logos, designs, databases, graphics, and Platform content remain the property of SearchCabs or its licensors.

Users may not copy, reverse engineer, reproduce, or redistribute any part of the Platform without written permission.

14. Availability

SearchCabs does not guarantee uninterrupted operation.

Maintenance, technical failures, internet outages, or third-party failures may temporarily affect availability.

15. Limitation of Liability

To the maximum extent permitted by law, SearchCabs shall not be liable for:

  • booking failures;
  • payment defaults;
  • customer disputes;
  • operator disputes;
  • vehicle breakdowns;
  • accidents;
  • personal injury;
  • death;
  • delays;
  • route changes;
  • cancellations;
  • business losses;
  • indirect damages;
  • loss of profits;
  • loss of goodwill.

Users participate entirely at their own commercial risk.

16. Indemnity

Users agree to indemnify and hold harmless SearchCabs, its owners, employees, affiliates, and representatives against any claims, losses, liabilities, damages, penalties, or expenses arising from:

  • misuse of the Platform;
  • breach of these Terms;
  • violation of applicable laws;
  • disputes with other users.

17. Suspension and Termination

SearchCabs may suspend or permanently terminate accounts without prior notice if users:

  • violate these Terms;
  • submit false information;
  • engage in fraudulent conduct;
  • misuse the Platform;
  • damage the reputation of SearchCabs.

18. Privacy

Use of the Platform is also governed by the SearchCabs Privacy Policy.

By using the Platform, users consent to the collection and processing of information necessary for providing the services.

19. No Partnership

Nothing contained in these Terms creates:

  • employment;
  • partnership;
  • agency;
  • joint venture;
  • franchise;
  • fiduciary relationship

between SearchCabs and any user.

20. Future Paid Services

SearchCabs currently provides its services without charging platform fees.

SearchCabs reserves the right to introduce subscription plans, transaction fees, advertising services, premium features, or other paid services in the future. Such charges will only apply after prior notice and acceptance by users where required.

21. Governing Law

These Terms shall be governed by the laws of India.

Subject to applicable law, the courts of Udaipur, Rajasthan shall have exclusive jurisdiction over disputes arising out of or relating to these Terms.

22. Changes to Terms

SearchCabs may update these Terms from time to time.

Continued use of the Platform after revisions constitutes acceptance of the updated Terms.
